Analysis of the Right to Defense in Ecuadorian Direct Proceedings and its Procedural Guarantees

Abstract

 

Justification: This study analyzes the right to defense within Ecuador’s direct procedure and its relationship with the procedural guarantees recognized in the Constitution of the Republic of Ecuador, focusing on the tension between procedural expediency and the effective protection of due process. Objective: To determine whether the regulation established in Article 640 of the Comprehensive Organic Criminal Code guarantees adequate time and means for the preparation of an effective technical defense. Methodology: A qualitative approach with documentary and bibliographic design was employed, based on the application of legal-dogmatic, analytical-synthetic, and exegetical methods through the examination of constitutional and criminal provisions, specialized legal scholarship, and jurisprudential criteria related to the right to defense, effective judicial protection, and due process guarantees. Results: The direct procedure is intended to expedite the processing of certain criminal cases by concentrating procedural actions; however, the reduction of procedural stages and the timeframe established for its conduct may limit adequate defense preparation in cases requiring extensive evidentiary analysis. Conclusion: The application of the direct procedure requires that the pursuit of procedural expediency be balanced with effective respect for the right to defense through judicial action that guarantees the time and means necessary for the exercise of an adequate technical defense.
